Terms of Service
These terms set practical expectations for using Kayan, including our controlled pilot, connected channels, and human-reviewed AI workflows.

1. Agreement
These Terms govern access to Kayan’s website, pilot program, and business operations platform. By creating an account, joining a pilot, or using the service on behalf of an organization, you confirm that you are authorized to accept these Terms for that organization.
2. Pilot and commercial service
Selected businesses may receive a focused 30-day pilot with scope, channels, usage limits, and success criteria agreed before activation. Kayan does not charge a setup fee for the standard pilot offer. Unless agreed otherwise in writing, a pilot does not guarantee continued free access. Any paid continuation, manual invoice, or future subscription will be confirmed before charges apply.
3. Accounts and authorized use
You must provide accurate information, protect credentials, maintain appropriate access for staff, and promptly notify Kayan of suspected unauthorized use. You may use Kayan only for lawful business purposes and in accordance with the rights and expectations of your customers.
4. Customer data and responsibility
You retain responsibility for data submitted by you, your staff, and your connected channels. You confirm that you have the notices, permissions, and lawful basis needed to process that data and instruct Kayan to perform the configured workflows. You are responsible for reviewing records and correcting inaccurate business information.
5. AI outputs and approvals
AI-generated classifications, extracted details, recommendations, and draft messages can be incomplete or incorrect. Kayan is an operational assistant, not a substitute for professional judgment. You are responsible for reviewing outputs and keeping human approval enabled for outbound, sensitive, urgent, regulated, or high-impact communication.
6. Connected services
Third-party services such as WhatsApp, Meta, hosting providers, email providers, and AI providers are governed by their own availability, terms, and policies. Kayan is not responsible for third-party suspension, policy decisions, outages, or changes outside our reasonable control.
7. Acceptable use
You may not use Kayan to send unlawful or deceptive communications, spam people without appropriate permission, violate third-party rights, distribute malicious code, bypass safeguards, probe other tenants, or process data in a way that violates applicable law or channel rules.
8. Availability and changes
We aim to provide a reliable service but do not promise uninterrupted availability. During a pilot, features may change as workflows are validated. We may modify, suspend, or discontinue functionality where necessary for security, law, provider requirements, or product development.
9. Confidentiality and intellectual property
Each party must use reasonable care to protect the other party’s confidential information. Kayan and its licensors retain rights in the platform, software, design, documentation, and service improvements. These Terms do not transfer ownership of customer data to Kayan.
10. Disclaimers and liability
Kayan is provided on an “as available” basis to the extent permitted by law. It does not provide medical, legal, accounting, or financial advice. To the extent permitted by applicable law, neither party is liable for indirect, incidental, special, or consequential loss. Any commercial order or pilot agreement may include more specific liability terms.
11. Suspension and termination
We may suspend access to protect the service, other customers, connected platforms, or legal compliance. Either party may end a pilot as agreed. On termination, access ends and data is handled according to the Privacy Policy and any written commercial agreement.
12. Governing principles and contact
These Terms are intended to operate under the applicable laws of Jordan, without limiting mandatory rights that apply elsewhere. Questions or formal notices may be sent to support@trykayan.com. Any customer-specific written agreement takes priority where it expressly conflicts with these Terms.
